Terms of Service – MusicEDU Suite
Effective Date: 1st October, 2025
Welcome to MusicEDU! These Terms of Service outline the conditions under which your school, teachers, and students access and use the MusicEDU Suite, which is hosted on our secure partner platform provided by Avallain AG.
By purchasing a subscription or accessing any MusicEDU materials, you agree to comply with these Terms.
1. Copyright & Usage Restrictions
- All MusicEDU content (including E-books, videos, PDFs, activities, and music files) is protected by copyright.
- Duplication, printing, screen-recording, or file-sharing of any resources is strictly prohibited unless explicitly permitted within the platform.
- Breach of copyright licensing (e.g. APRA/AMCOS, AMCOS Print Music Licences) may result in financial penalties and immediate termination of access.
- Content is for educational use within the subscribing school only and must not be shared externally or between schools.
2. Platform Access
- The MusicEDU Suite is delivered via a cloud-based platform managed by Avallain AG, based in Switzerland.
- Each student requires a unique login tied to their school and class. Student logins are non-transferable across terms or between users.
- Each teacher is granted a personal login with administrative tools to manage students, sessions, and reporting.
- Schools are responsible for maintaining the accuracy of teacher and student user data during setup.
3. Subscription and Licensing Terms
- Subscriptions are licensed annually, based on the number of students accessing the resources across the school year.
- Pricing is tiered according to student enrolment estimates provided at the time of quotation.
- Subscription terms begin from the date of login activation or within 14 days of quote acceptance (whichever comes first).
- If your student numbers change mid-year, please contact us to discuss scaling options.
4. Refunds, Cancellations & Expired Licenses
- Due to licensing and copyright regulations, no refunds can be issued once:
- A quote has been accepted, or
- A purchase order has been received.
- A quote has been accepted, or
- This includes cases where a license is unused, cancelled early, or expired.
- Please ensure student numbers and access needs are accurate before confirming your subscription.
5. Login Provisioning & Support
- Teacher logins are activated within 1–2 business days of receiving a valid purchase order.
- Student logins are processed once payment is received and the school’s student login request form is completed.
- All logins are delivered via email to the designated school contact.
- If using Single Sign-On (SSO), setup must be coordinated with your school’s IT team and MusicEDU support.
6. Service Availability and Updates
- Platform maintenance and updates are managed by Avallain and may result in occasional downtime. We aim to provide notice of planned outages where possible.
- Content and features may be updated throughout the year to reflect curriculum changes or platform improvements.
7. Data Security and Privacy
- All user data is processed in accordance with our Privacy Policy, which complies with the Australian Privacy Principles.
- Student data is stored securely and is accessible only to authorised school personnel.
- The platform hosting partner (Avallain AG) also complies with international data protection laws, including GDPR and Swiss privacy law.
8. Fair Use and Account Conduct
- Teacher and student accounts must only be used by the individual assigned to that login.
- Any misuse of login sharing, unauthorized access, or attempt to extract materials outside of the platform may result in account suspension or termination.
